Final Agency Determination: FAD-281

Subject: Two requests dated June 28, 2018, and July 17, 2018, to the Risk Management Agency (RMA) requesting a Final Agency Determination for the 2015 crop year regarding the interpretation of section 3(g)(4) and section 14 of the Common Crop Insurance Policy Basic Provisions (Basic Provisions), published at 7 C.F.R. § 457.8. This request is pursuant to 7 C.F.R. § 400, subpart X.

Background:

Section 3(g)(4) of the Basic Provisions states, in relevant part:

MGR-18-011: Emergency Procedures for Crops Damaged by Hurricane Florence

Background

Hurricane Florence caused catastrophic damage in many counties in North Carolina and South Carolina. The Risk Management Agency (RMA), in conjunction with Approved Insurance Providers (AIPs), recognize the need for authorizing emergency procedures that will streamline certain loss determinations on specific crops, accelerating the adjustment of losses and issuance of indemnity payments to crop insurance policyholders in impacted areas.

MGR-18-013: Additional Emergency Procedures for Crops Damaged by Hurricane Florence

Background

On September 24, 2018, the Risk Management Agency (RMA) issued MGR-18-011, Emergency Procedures for Crops Damaged by Hurricane Florence, authorizing emergency procedures that will streamline certain loss determinations on specific crops, accelerating the adjustment of losses and issuance of indemnity payments to crop insurance policyholders in impacted areas.

MGR-18-012: Macadamia Tree Crop Provisions for the 2019 Crop Year

Background

The Federal Crop Insurance Corporation Board of Directors approved a new Macadamia Tree Crop Insurance Program (19-MT) and Comprehensive Tree Value (CTV) Endorsement (19-MT-A) submitted under section 508(h) of the Federal Crop Insurance Act in May 2018. To avoid the redundancy of administering two policies with generally similar coverage, the Risk Management Agency (RMA) will not offer the existing Macadamia Tree Crop Provisions (16-0024) for the 2019 crop year.

MGR-18-010: Conversion of the Hawaii Tropical Fruit and Tree Programs to Permanent Status

Background

The Hawaii Tropical Fruit and Tree Crop Insurance Programs have been piloted to determine acceptance by producers as effective and affordable risk management tools and to assure the programs are actuarially sound. The Federal Crop Insurance Corporation Board of Directors (Board) granted approval for the conversion of these programs from pilot to permanent status based on the favorable pilot program experience.
