Practical to Replant Determinations for the 2017 Crop Year
Background

Due to flooding and extreme wet weather in some parts of the country, questions have been asked regarding the definition of practical to replant for the 2017 crop year contained in the Common Crop Insurance Policy, Basic Provisions. The definition states:

Practical to replant - Our determination, after loss or damage to the insured crop, based on all factors, including, but not limited to moisture availability, marketing window, condition of the field, and time to crop maturity, that replanting the insured crop will allow the crop to attain maturity prior to the calendar date for the end of the insurance period. It will be considered to be practical to replant within or prior to the late planting period, or on or prior to the final planting date if no late planting period is applicable, unless we determine it is physically impossible to replant the acreage or there is no chance of seed germination, emergence, and formation of a healthy plant.

In particular, questions have been raised regarding whether a determination that acreage is physically impossible to be replanted or there is no chance of seed germination, emergence, and formation of a healthy plant can be made before the end of the late planting period.

Action
A determination that acreage is physically impossible to be replanted or there is no chance of seed germination, emergence, and formation of a healthy plant, can be made at any time the Approved Insurance Provider can properly assess and conclude that circumstances have rendered the acreage impossible of meeting such conditions including before the end of the late planting period.
