RMA makes determinations regarding participation in or receipt of benefits, compliance with
program requirements, and making or amount of payments or other benefits. A
participant who disagrees with an agency decision (except for Good Farming Practice Determinations)
has the right to appeal the adverse decision to NAD. NAD also does not have authority to hear appeals
regarding matters of general applicability -- that is, those applicable to all similarly situated
participants. The participant has the burden of proving that the decision of the agency was
erroneous by a preponderance of the evidence.
By regulation, RMA must implement final NAD determinations no later than 30 days after the effective date
of the notice of the final determination. Beginning January 2009, pursuant to section 14009(b) of the 2008
Farm Bill, RMA will list these NAD final determinations.
